Terms of Service

These Terms govern your use of oceamcharters.com and any charter you book through Oceam & Co. (“Oceam,” “we,” “us”). By using our site or booking with us, you agree to these Terms.

1. Who we are — important

Oceam & Co. is an independent charter broker and concierge. We connect you with licensed, insured, third-party vessel operators. We do not own, operate, crew, or control the vessels. The operator is solely responsible for the vessel’s operation, seaworthiness, crew, insurance, and compliance with maritime and safety laws.

2. Bookings, quotes & deposits

• Prices and availability are estimates until confirmed with the operator.
• A $500 deposit secures your date; the remaining balance is due on the day of the charter unless stated otherwise.
• Guest counts are capped by each vessel (typically up to 13). You are responsible for providing an accurate party size.

3. Cancellation & weather policy

• If a charter is postponed, cancelled, or cut short due to weather — captain’s discretion, a small-craft advisory, or a National Weather Service storm warning — we will work with you to reschedule.
• Any provisioning already purchased is yours to keep. Sealed, non-perishable items are held and applied to your rescheduled date at no extra cost; perishables may be re-provisioned on the new date at your cost.
• Service, handling, and sourcing fees already incurred are non-refundable. Specific operator cancellation terms may also apply and will be shared before booking.

4. Provisioning & alcohol

Food and drink provisioning is an optional add-on. Alcohol, where included, is served only to guests 21+; valid ID may be required, and the crew may refuse or stop service at their discretion. You are responsible for your guests’ lawful, responsible conduct.

5. Gratuity

Crew gratuity is not included in the charter price unless stated. Gratuity is customary and, for some evening charters, required at 10–15%. The policy for your specific vessel is shared before booking.

6. Promotions & offers

Promotional offers (for example, a complimentary welcome bottle for new email subscribers) are limited to one per client per qualifying charter, apply to the first eligible booking unless stated, have no cash value, cannot be combined with other offers, and may be changed or withdrawn at any time. The complimentary bottle is an onboard amenity provided with a booked charter, not a separate sale of alcohol.

7. Assumption of risk & limitation of liability

Boating involves inherent risks. To the fullest extent permitted by law, Oceam & Co. is not liable for the acts or omissions of vessel operators, weather, or guest conduct, or for any injury, loss, or damage arising from a charter. Our total liability for any claim is limited to the amount you paid to Oceam & Co. for the booking in question. Nothing in these Terms limits liability that cannot be limited by law.

8. Your responsibilities

You agree to provide accurate booking information, ensure your guests follow the captain’s instructions and all laws, and not use our services for any unlawful purpose.

9. Indemnification

You agree to indemnify and hold harmless Oceam & Co. from claims arising out of your or your guests’ conduct or breach of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Miami-Dade County, Florida.

11. Changes

We may update these Terms; the “effective date” above reflects the latest version. Continued use after changes means you accept them.
